IOK court orders release of 3 youth detained under PSA

Srinagar, March 30, 2016 (PPI-OT):In occupied Kashmir, the High Court has quashed the illegal detention of three youth who were booked under black law, Public Safety Act (PSA), and has directed the police to release them. Justice Rabistan Tashi while terming the detention of Nasir Ahmed Ganai, a resident of Raipora Palhallan, as illegal, quashed his PSA and directed the police to release him.

Advocate Bashir Ahmed Tak, counsel for Nasir Ahmed Ganai submitted before the court that all the charges levelled against his client were frivolous while the fact was that he had already been bailed out by court and yet PSA was slapped on him.

“My client was arrested on 31 January 2014 and the irony is that police have charged him for the alleged role in stone-pelting in the year 2010. What were police doing and why it waited for 4 long years? Police have also accused him of being the part of group that pelted stones on a police vehicle in October 2013 in Palhallan and for that charge he had already been bailed out by the court,” Advocate Bashir Ahmed Tak told the court.

After hearing the arguments from both the sides, Justice Rabistan Tashi quashed his detention under PSA and directed the police to release him. Nasir has been lodged at Kathua jail in Jammu. In another case, Justice Muzaffar Hussain Attar quashed the detention of a computer engineering student, Muhammad Adil Mir, under draconian PSA. Mir also hails from Raipora area of Palhallan.

The High Court also quashed PSA detention of Zubair Ahmed Turray, a resident of Bongam area of Shopian, against whom PSA had been slapped for participating in anti-India demonstrations. The court ordered immediate release of Zubair Turray. He has been lodged at Udhampur jail in Jammu since November 2015.
