Indian army to face PIL in Kunan poshpora mass rape

Srinagar, February 24, 2013 (PPI-OT): In occupied Kashmir, the Jammu and Kashmir Coalition of Civil Society (JKCCS) along with women activists have decided to file a Public Interest Litigation (PIL) against the Army personnel of 4-Rajputana Rifles for 1991 Kunan Poshpora mass rape.

The JKCCS Coordinator, Khurram Pervez, in a media interview in Srinagar said that they were waiting for the authorities to act on the recommendations of the Human Rights Commission of the territory and initiate a probe but due to the failure of the puppet administration, they would file a PIL.

He said, “We were hopeful when the Human Rights Commission asked the authorities not only to reinvestigate the case but also prosecute the then director (prosecution) for recommending that the case should be closed but nothing happened.”

Khurram Pervez said that the puppet administration, Press Council of India (PCI), B.G.Verghese and the then director (prosecution) would also be made party to the PIL.

It is to mention here that the Commission had constituted a division bench and asked the authorities to constitute a Special Investigation Team (SIT) for re-opening the case. The Bench comprising Chairman of the Commission, Justice (Retd) Syed Bashiruddin Ahmad, and Justice (Retd) Javaid Kawoosa, had asked the authorities to prosecute the then director (prosecution) for recommending that the case should be closed.

The division bench had said in its recommendations that at least 30 women of Kunan Poshpora were gang-raped by army personnel of 4-Rajputana Rifles on intervening night of February 23/24 in 1991.
